  • Open License
    This license applies for the following types of facilities:
    • Marijuana Cultivation Facilities: For growing cannabis, with two categories—small-scale (≤ 2,500 sq. ft. indoor or ≤ 1 acre outdoor) and large-scale ( > 2,500 sq. ft. indoor or > 1 acre outdoor).
    • Marijuana Product Manufacturing Facilities: For businesses processing cannabis into various products.
    • Retail Marijuana Stores: For businesses selling cannabis directly to consumers.
    • Marijuana Testing Facilities: For testing cannabis products for quality and safety.
  • Social Equity License
    The Social Equity License is designed to support individuals from communities disproportionately affected by previous marijuana laws. To qualify for this license in Delaware, applicants must meet the following criteria:
    • At least 51% ownership by individuals who have resided in a disproportionately impacted area for at least 5 of the past 15 years.
    • Owners must have a qualifying marijuana-related offense or be closely related to someone who does.
  • Microbusiness License
    The Microbusiness License is for small-scale operations planning to employ no more than 10 employees. Additionally, the facility must have a marijuana plant grow canopy area of no more than 2,500 square feet, making it ideal for smaller, localized operations.
