Overview of Cannabis in Alabama

Alabama’s cannabis market is evolving rapidly, with significant opportunities for entrepreneurs in the medical marijuana sector. While recreational cannabis remains illegal, the medical marijuana program has grown steadily since its legalization in 2021. The medical cannabis market is projected to reach $19.7 million by 2024, generating economic benefits such as tax revenue and reduced criminal justice costs.

The Alabama Medical Cannabis Commission (AMCC) had been awarding licenses for various roles in the cannabis industry, including cultivators, processors, distributors, and testing laboratories. One-quarter of these licenses were reserved for minority-owned businesses, which created potential opportunities for underrepresented groups.

With the state’s licensing system still developing, particularly for dispensaries and integrated facilities, the timing is right for companies to get involved. Despite limitations, such as a cap on the number of licenses, Alabama’s medical cannabis industry offers promising potential for growth.

Alabama Cannabis License Types

Different medical marijuana license types are available to applicants under SB 46, with licenses granted based on public applications:

  1. Dispensary License: This license allows a company to dispense and sell medical cannabis at designated sites to registered physicians and caregivers. The state permits a total of four dispensaries, with three locations in different counties. The fee for a dispensary license is $40,000.
  2. Cultivator License: This license allows a company to grow cannabis. The state plans to license at least four cultivators, each paying a $40,000 fee.
  3. Processor License: This license allows a company to purchase cannabis from a cultivator, extract derivatives, and then package and label cannabis products for sale at a dispensary. Only four processor licenses will be issued, with a fee of $40,000.
  4. Secure Transporter License: This license allows a licensed facility to transport cannabis or medical cannabis to other licensed facilities. The fee for this license is $30,000.
  5. Testing Laboratory License: This license is for laboratories that test cannabis products to ensure they meet the safety requirements of the law. The fee for a testing laboratory license is $30,000.
  6. Integrated Facility License: This license allows a company to perform the functions of a cultivator, processor, secure transporter, and dispensary. The state will issue only five integrated facility licenses, with a $50,000 fee.

The state legislature has capped the number of licenses available in each category: four dispensary licenses, twelve cultivator licenses, four processor licenses, and five integrated facility licenses. The number of licenses for secure transport and testing laboratories has not been specified.
