With more than 1.5 million Texans over 21 using cannabis monthly, experts estimate that a legal cannabis market in Texas could generate $2.7 billion in annual sales. If taxed at rates similar to Colorado, cannabis could bring in over $1.1 billion in state revenue every two years, with business licensing fees contributing an additional $10 million annually. Legalization would not only create new business opportunities but also save the state approximately $311 million per year by eliminating the costs of low-level cannabis arrests and prosecutions.

The medical cannabis industry in Texas also presents opportunities. Although the Texas Department of Public Safety is not currently accepting new applications for medical dispensaries, future expansion of the Compassionate Use Program could allow more businesses to enter. 

Recent legislative activity indicates a growing push for reform. In November 2024, lawmakers introduced HB 1208, a bill that would legalize and regulate adult-use cannabis, allowing possession of up to 2.5 ounces, 15 grams of concentrates, and 10 ounces at home. The bill proposes a 10% sales tax and sets up a regulated market overseen by the Texas Department of Licensing and Regulation. Although Texas has historically been slow to embrace legalization, increasing voter support, bipartisan discussions, and economic incentives suggest that major changes could be on the horizon.

For entrepreneurs, positioning early in Texas’ cannabis industry could be a game-changing opportunity. Texas Cannabis License Types

The Texas Department of Public Safety (DPS) currently issues only one type of cannabis business license: the Dispensing Organization License under the Compassionate Use Program (CUP). This license allows businesses to cultivate, process, and dispense low-THC (up to 0.5%) cannabis to registered medical marijuana patients. There are only three licensed dispensing organizations in Texas at this time.

Unlike other states, Texas does not offer separate cultivation, processing, or retail dispensary licenses—all operations are vertically integrated under the Dispensing Organization License.

For testing, licensed dispensing organizations must have their products tested and reported per DPS regulations. However, there is no independent cannabis testing license currently available in Texas.

The latest licensing window for dispensing organizations was open from January 16 to April 28, 2023, and DPS is not currently accepting new applications.
